The client decided to acquire an account featuring a famous character from the game "L," known for its active online and offline cash transactions, from the defendant. To enhance the game account, the client either purchased items directly or requested the defendant and others to buy items on their behalf, paying the relevant amounts.
Throughout this process, the client spent over tens of millions of KRW on item purchases. However, the defendant used hacking as an excuse to not transfer the account and instead transferred it to their own name, leaving the client without the account.
Decent's Strategy
In the first instance, the court ruled that the defendant must return part of the payment for the items purchased to equip the game character. However, the defendant argued that the transaction with the client was a contract for the purchase of items, claiming they would return the "items" instead of the "amount."
In response, Decent Law Firm clarified, using clear logic and evidence regarding the circumstances surrounding the agreement between the client and the defendant, that they had entered into a contract for the transfer of the account, not for the purchase of items. We asserted the claim for the return of the amount equivalent to the purchased items.
Results & Significance
Decent Law Firm established that there was never a "contract for item purchase" and provided evidence to support this. We argued that the existence of the items held no intrinsic value for the client, making the claim legally valid. This argument was accepted, allowing the client to recover the respective amount.
