Settlement Representation for Victims of Threats Involving Intimate Videos — KRW 20 Million Recovered

Case Details

The clients were threatened by a person they had previously known, who claimed that intimate videos would be distributed unless money was paid.

The other party repeatedly contacted the clients through KakaoTalk and social media and also approached their family members, referring to the videos while making demands for money.

The clients retained Decent Law Firm to file a criminal complaint regarding the threats involving intimate footage and to represent them in subsequent settlement negotiations with the other party.

Decent's Strategy
Decent Law Firm reviewed KakaoTalk messages, social media conversations, account information, and contact records preserved by the clients and organized the threats and monetary demands in chronological order.

Based on this evidence, we pursued a criminal complaint after reviewing potential charges for threats involving sexual images or recordings under the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes, as well as attempted extortion under the Criminal Act.

We then represented the victims throughout the settlement process so that they would not have to communicate directly with the other party. Our work went beyond negotiating the amount of compensation: we also reviewed the payment terms, the scope of the victims’ statement of non-punishment, and provisions concerning any future civil or criminal claims.

As a result, the victims received a total settlement payment of KRW 20 million. After confirming payment, Decent Law Firm submitted the settlement agreement and statement of non-punishment on their behalf.

The criminal case subsequently proceeded to trial, where the defendant received a suspended sentence, bringing the proceedings to a close.

We organized not only evidence showing possession of the intimate footage, but also the specific threats, the circumstances surrounding the demands for money, and communications directed at both the victims and their family members. These materials were submitted as part of the criminal complaint.

Because cases involving intimate footage can make direct contact with the other party particularly distressing for victims, Decent Law Firm handled the settlement process on their behalf and minimized the need for direct communication.


▪️ KRW 20 Million in Financial Recovery

The victims ultimately received a total of KRW 20 million in settlement payments. After reviewing the settlement terms, the settlement agreement and statement of non-punishment were submitted.

The defendant was later given a suspended sentence, and the criminal proceedings concluded. The settlement outcome and the court’s sentencing decision should, however, be understood separately; the settlement should not be described as the sole or direct reason for the suspended sentence.
